To the maximum extent permitted by applicable law, Basicmicro.com, Inc. shall not be liable for any direct, indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, revenue, data, or use, incurred by the Buyer or any third party, whether in an action in contract, tort, or otherwise, arising from the use of, or inability to use, the product(s) and/or services provided by Basicmicro.com, Inc. In no event shall Basicmicro.com, Inc.'s total liability for any and all claims arising under these terms exceed the amount paid by the Buyer for the specific product(s) and/or services at issue.
